What are the ACT’s enhanced powers in overseeing worker redundancies?

During the term of the extension of the state of emergency decreed by the President of the Republic, whenever a labour inspector verifies that there are indications of dismissal in breach of the rules laid down in Articles 381, 382, 383 or 384 of the Labour Code, a notice shall be drawn up and notified the employer to regularise the situation.

With the notification to the employer and until the situation of the worker is settled or the final transit of the judicial decision, as the case may be, the employment contract in question does not cease, maintaining – if all the rights of the parties, in particular the right to retribution, as well as the inherent obligations under the general social security system.
