In today’s newsletter, we address a very current issue, not only because of Brexit, but also because of the decision of the Court of Justice of the EU which last July invalidated the adequacy of the Privacy Shield: International Data Transfers.
For the United Kingdom, the Trade and Cooperation Agreement signed with the EU provides for the extension of the interim Brexit period for international data transfers until the Commission can decide on the adequacy of the United Kingdom, ensuring an adequate level of protection (a situation provided for in Article 45 gdpr). This means that, during this period, the United Kingdom is not considered a third State, so that flows of personal data may continue to occur.
To help organisations transferring personal data to third countries, the European Committee and the European Data Protection Supervisor have made available a set of new standard contractual clauses for international transfers, which will replace the existing clauses – this proposal has several new developments and the European Committee has also made some recommendations.
