The promotion of equal pay between women and men for equal work or work of equal value is one of the main measures under the Decent Work Agenda.
To respond to this requirement, the Authority for Working Conditions (ACT) annually notifies thousands of companies that have disparities in the balance of the pay differences between women and men, based on the data reported in the Single Report.
All notified companies have a period of 120 working days to submit a Salary Difference Assessment Plan and demonstrate to the ACT that the salary differences detected are not the result of discriminatory practices, and that the evaluation of the components of the employees’ functions must be based on objective and common criteria for men and women.
For the preparation of this Evaluation Plan, the notified entities must carry out a true audit of the remuneration practiced and the respective remuneration policy, with an exhaustive survey of all the existing jobs in the company, functions specifically performed in each position and identification of the respective remuneration components, worker by worker.
Failure to submit the Evaluation Plan constitutes a serious administrative offence, and the fine may amount to a maximum of 13 thousand euros, as well as being accompanied by an ancillary sanction of exclusion from participation in auctions or public tenders for a period of up to two years.
